  • First offense (.10 or over)
    • Up to 30 days in jail
    • Seven-month to one-year license suspension
    • Up to 48 hours at IDRC
    • Up to $4,005 in total fines, surcharges and assessments
    • Six-month to one-year ignition interlock after restoration (.15 or over)
  • Second offense
    • 48 hours to 90 days in jail
    • Two-year license suspension
    • 30 days of community service
    • Up to 48 hours in IDRC
    • Up to $6,000 in total fines, surcharges and assessments
    • Ignition interlock for one to three years after restoration
  • Third offense
    • 180 days in jail
    • Ten-year license suspension
    • Up to 90 days of community service
    • Up to 48 hours in IDRC
    • Up to $4,555 in total fines and assessments
    • Ignition interlock for one to three years after restoration

In addition to and independent of these DUI consequences, refusing to submit to chemical testing carries a fine of up to $500 and a seven-month license suspension.
