Employees covered under the state’s Workers’ Compensation Law

The New Jersey Workers’ Compensation Law covers virtually all private and public sector employees—including full-time, part-time and seasonal workers—from day one. Independent contractors, however, are generally not covered unless they are misclassified and can prove they function like regular employees. 

Your injury or illness must also qualify. It must arise out of, and occur in the course of, employment. This means the injury must be directly related to your performance of job duties.

Workers’ comp eligibility in special cases

  • Remote workers — With the rise of telecommuting, many wonder whether injuries sustained while working from home are covered. Requirements for filing a claim

  • Report the injury to their employer — Ideally you should notify your employer within 14 days, but no later than 90 days.
  • Seek medical treatment — You can receive emergency treatment from any licensed facility, but your employer can require you to see a selected physician for non-emergency medical treatment.

If your employer disputes your claim, you have the right to appeal to the Division of Workers' Compensation.
