What Is the New Jersey Complex Business Litigation Program?

In every trial, judges are responsible for ensuring that the case proceeds fairly and in accordance with the applicable laws. For this reason, New Jersey has established the Complex Business Litigation Program (CBLP).

Under the CBLP, at least one judge in every vicinage is designated to handle cases arising from complex business disputes, which might include one or more of the following characteristics: 

  • Numerous parties, which could lead to scheduling difficulties and a large amount of pre-trial motions

  • Extensive discovery involving large volumes of physical documents, electronic records or financial data 

  • Multiple expert witnesses who are needed to review the facts and render their opinions on scientific, technical, financial or industry-specific issues

  • Cases that could have an effect on issues beyond the specific dispute, such as matters associated with regulatory compliance or industry-wide practices

  • Litigation requiring significant interpretation of business or commercial law

Cases that fall under the CBLP can include contract disputes, business torts, shareholder litigation, complex construction disputes and conflicts involving closely held corporations. A claim is automatically assigned to the CBLP if the amount in controversy is at least $200,000 and the parties declare in their filings that the case is a complex commercial or complex construction matter. Judges may also refer qualifying cases to the CBLP based on their complexity, even if they were not designated as such by the litigants.
